My job title is Medical Records Clerk/Transcriptionst. Because of a downsizing, they opted to terminate my two positions, thus attempting to terminate my employment. Heard that he is wanting to outsource my job description to a coworker's family member who will be working from home. She likewise works the same job description although in another building across town. I have nine years seniority and as far as I am concerned...this smacks nepotism. I have never had one write-up. Have 642 hours sick leave and 425 hours vacation time. Obviously the company came first. I need to work and the offer was for 16 hours, no benefits. I need 20 hours to maintain benefits. Is there anyone in power-surge-ville who can offer me some advice as to what direction to take? I can't but feel I have some sort of case but don't know which way to go.

I don't have much advice - other than it sounds like you might want to talk to a lawyer. That really stinks, and is soooooo unfair.

Do you have a Labour Standards Board there?? I am in Canada, and I was wrongfully dismissed several years ago.....and I sued thru the Labour Standard Board, and the guy settled with me before the hearing. I didn't get my job back, but in my case, I didn't want it!!
I am so sorry you are having to deal with this!! I sure seems like a lot of people are getting fired, laid off, etc. It is just sad.

Whether or not your company has to comply with certain workplace rules depends on how many people are employed. If the company is small (IIRC, under 50 people) they do not fall under many of the EEOC rules. Talk to a lawyer, they should be able to give you a free consultation and let you know if you have a case.

Just to say I am so sorry for what you are going through.It sounds not only unfair but also illegal
Am afraid I too know nothing about your Labour Law as I have live in The Middle East where whole system is totally corrupt

First of all hugs to you and I am sorry this is going on.
Try contacting your state's labor board. They should have a legal division that can answer your questions and let you know what you can do about it. It should be free also.
I will keep you in my prayers.

I too want to offer a hug to you Sybille. I have little to offer to you in the way of advice unfortunately, but I am sorry for your situation. It is of course most unfair!

I am so sorry this is happening to you! It's just not right! I use to think that most people were trustworthy, (at least to a certain extent) but I'm finding more and more that that's not the case.

sybille - it sux doesn't it? Nepotism is immoral...I was fired last day b4 Christmas break after 15 years of teaching at the same place...new administrator jealous and threatened by my experience and the fact that I loved my job..totally out of the blue...could I go to a lawyer? Probably...should u go? u could..I guess u need the emotional strength...I have heard so many stories...this ageism is awful.. a lot of older people let go...I guess this philosophical kick in the face that people are not good and busniness and bosses are not trustworthy...it's a hard pill to swallow...bad things do happen to good people...I may have to go on Celexa to get over this....I hope u can be stronger than me...

That is horrible! Well here is an update as well as it being a kick. I don't have to worry about whether I should seek legal recourse or not. The entire place is going to close in a month. 38 of us have lost our jobs. We were told yesterday via email sent by the main hospital. No warning except to say that the director knew about this LAST Friday and was not around Monday, Tuesday or Wednesday but did come in with a spokesperson shortly after we received the email Thursday. GREAT Place, huh! He knew about this but sent a coworker to California to drum up business Monday. She called in last night and one of the nurse's told her to come back - that she as "making a fool of herself" given the situation.
Changed my W-2 form to get the maximum of the few remaining paychecks, as well as severance and earned time off payments. Not going to give a "red $0.01" to the company. Cash on hand is what it is all about. I think we are still in a bit of a daze! And there is some under current anger, let me tell you!

Sybille, I am so sorry to read this current happening!! Sounds like you are doing anything you can to empower yourself considering the unethical way the whole thing was handled. You found out in an e-mail !!! How low is that
